Agreement between User and USA Lending, Inc. (“USA Lending”).

Welcome to USA Lending, provider of USA Lending marketing technology. USA Lending, LLC operates https://usalending.com, each with various webpages, and is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of https://usalending.com constitutes your agreement to all such Terms. Please read these terms carefully and keep a copy of them for your reference.

USA Lending is a Software-as-a-Service (SaaS) based technology and marketing company. USA Lending engages with customers to assist them in submitting consumer loan requests via the USA Lending technology platform.

Your use of https://usalending.com/privacy-policy is subject to USA Lending’s Privacy Policy. Please review our Privacy Policy, which also governs the website and informs users of our data collection practices.

Electronic Communications

Visiting https://usalending.com or sending emails to USA Lending constitutes electronic communications. You consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications that we provide electronically, via email and on the site, satisfy any legal requirement that such communications be in writing.

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. You may not assign or transfer your account to any other person or entity. USA Lending does not knowingly collect, either online or offline, personal information from individuals under the age of thirteen. USA Lending does not knowingly solicit or collect information from visitors under eighteen (18). You may not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or exploit any content, in whole or in part, found on the site. USA Lending content is not for resale. Your use of the site does not grant any rights to use protected content, and you may not delete or alter proprietary notices. You agree that you do not acquire ownership rights in any protected content. The service is controlled, operated, and administered by USA Lending from our offices within the USA. Indemnification

Arbitration

In the event of any dispute arising from or related to these Terms and Conditions, whether in contract, tort, or otherwise, the dispute shall be resolved through final and binding arbitration pursuant to the Federal Arbitration Act. The arbitration will be conducted by a single neutral arbitrator, administered by the American Arbitration Association or a mutually agreed arbitration service. The arbitrator’s award shall be final, and judgment may be entered in a competent court. The prevailing party shall recover reasonable costs and attorney’s fees. Arbitration shall survive the termination of these Terms and Conditions.

Class Action Waiver

By agreeing to these Terms and Conditions, you expressly waive the right to participate in any class action, collective, or representative proceeding against USA Lending. All disputes or claims arising out of or relating to these Terms must be resolved through individual arbitration. You agree that claims can only be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative action. The arbitrator may not consolidate multiple claims or preside over any form of a collective or class proceeding.

Liability Disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY CONTAIN INACCURACIES OR TYPOGRAPHICAL ERRORS. PERIODIC CHANGES ARE MADE TO THE INFORMATION. USA LENDING, INC AND ITS SUPPLIERS RESERVE THE RIGHT TO MAKE IMPROVEMENTS OR CHANGES TO THE SITE AT ANY TIME. USA LENDING, INC AND ITS SUPPLIERS PROVIDE ALL INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND. IN NO EVENT SHALL USA LENDING, INC OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER, INCLUDING DAMAGES FOR LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF THE USE OR PERFORMANCE OF THE SITE, DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, OR ANY OTHER INFORMATION OBTAINED THROUGH THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF USA LENDING, INC HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. A printed version of this agreement or any electronic notice will be admissible in judicial or administrative proceedings to the same extent as any business records originally generated in printed form. Loan Eligibility Service

Eligibility for loans through USA Lending is determined based on various criteria, including but not limited to creditworthiness, income, employment status, and compliance with federal and state lending regulations. Meeting the basic eligibility criteria does not guarantee loan approval, as additional factors, such as debt-to-income ratios and credit checks, may affect final approval. USA Lending reserves the right to deny loan applications at its sole discretion. All loan terms and conditions, including interest rates, will be disclosed during the application process.

Opt-Out & Unsubscribe from Third Party Communications

Automatic Collection. We, our service providers and our third party partners may automatically capture information about you, your computer or mobile device, and your activity over time on the service and other online services, including:
